General terms of sale
The seller named Herman Headwear, registered with the ECB under number BE0418 161 357, whose registered office is at rue Jean Meunier 6, 6992 WELLIN (Belgium).
The buyer referred to as the customer.
Application of the general conditions of sale
The order by the customer implies acceptance of all of these general conditions.
The products available for sale are those listed on the site. Herman Headwear has a structure to provide the maximum amount of advice to its client. The customer accepts the presence of any errors on the site. If necessary, the customer may withdraw and Herman Headwear will proceed with any reimbursement invoiced. The items on the site are available while stocks last.
In order to ensure the smooth running of the order, Herman Headwear customers are required to have a physical delivery address.
The prices of the products on the Herman Headwear site are presented in euros and inclusive of tax. The amount of VAT is isolated and indicated when ordering by the customer. In the event of a change in VAT, the price will be modified accordingly. No prior information should be given to the customer.
Secure order and payment
Log in to Herman Headwear
When placing their first order, the customer has a username and password. For subsequent orders, the customer being already registered on Herman Headwear, he will be exempt from filling out the identification form again. The password is strictly confidential and personal and should not be disclosed or communicated to anyone. In the event of loss or forgetting, the customer can obtain a new password by clicking on "Forgot password?" »And by entering his email address in the appropriate field.
The customer expressly authorizes Herman Headwear to place a so-called "cookie" file on the customer's hard drive, the sole purpose of which is to facilitate said identification.
After selecting the products from the online catalog of the Herman Headwear site, the customer confirms his order and accepts these general conditions of sale.
The customer places his order by filling his basket. After verification, the customer confirms his order on Herman Headwear. A possible promo code can be introduced.
For any first order, the customer is required to complete a form containing his contact details.
All our payments are guaranteed secure via the platform of our service provider Ogone. The customer has the option of paying by credit card (bancontact / mistercash, maestro or credit card) or with Paypal. After having validated the data encoded for his payment, the customer validates his order definitively and irrevocably.
Payment secured by debit card
The customer confirms his delivery and billing address, the product and the total price. He provides his bank card number associated with the expiration date and the CVX code. He finally validates his order by clicking on the "Confirm" button.
To ensure the security of credit card payments on the site, Herman Headwear uses a secure payment service. This service integrates the SSL security standard. Confidential data (the 16-digit bank card number as well as the expiration date, the CVX code) are directly transmitted encrypted to our bank's server without passing through the physical media of the Herman Headwear server. When the order is validated, the payment request is routed in real time to the secure electronic payment manager. This sends an authorization request to the bank card network. The electronic payment manager issues an electronic certificate which will serve as proof of the amount and date of the transaction.
Secure payment by Paypal
With PayPal, the customer's financial information is never communicated to Herman Headwear. PayPal encrypts and protects the customer's card number once and for all. The customer pays online by simply indicating his email address and password.
Default of payment
If a previous order remains partially or fully due, Herman Headwear reserves the right to refuse a new order and to make a delivery.
For orders with a delivery address different from the billing address, for a new customer or for orders over 200 euros, Herman Headwear may request additional information. These controls aim to protect Herman Headwear from abusive practices operated by fraudsters. Herman Headwear may request proof of address or debit in your name, or proof of address in the name of the person indicated for the delivery address, etc. These requests will be made by return email.
For any order placed before 11 a.m. (excluding weekends and holidays), shipping is done the same day. The products ordered by the customer will be delivered in Belgium within 48 hours, in Europe within 72 hours and outside Europe within a maximum of thirty (30) days to the address indicated by the customer when ordering on Herman Headwear. Except in special cases or unavailability of one or more products, the products ordered will be delivered in one go. The user is solely responsible for a delivery defect due to a lack of information when ordering.
Shipping costs include packaging, handling and postage. These are included when the order is placed. The customer can request an estimate of the shipping costs. They are free for any order exceeding 75 € for countries in the Europe Zone (excluding islands). Some packages may not be delivered by our transport provider for the following reasons:
Returns due to NPAI. These are packages returned by the service provider responsible for delivery under the mention: Does not live at the Address Indicated. After receipt and acceptance of the package by our services, Herman Headwear will contact the customer in order to return his order (shipping at the customer's expense) if the product is still available or to refund the order according to the customer's wishes. . Returns for "NOT CLAIMED". These are packages that have not been claimed by the customer at the post office, or at the relay point within the time limits. After receipt and acceptance of the package by our services, Herman Headwear will contact the customer in order to return their order (shipping at the customer's expense) if the product is still available or to refund the order according to the customer's wishes. . Herman Headwear reserves the right to reimburse the order and not to return it in the event that several "NOT CLAIMED" are identified.
Returns for "REFUSED". These are packages that were refused by the customer at the time of delivery. After receipt and acceptance of the package by our services, a voucher will be credited to the customer account within 72 hours of receipt of the package. The customer can request the cancellation of the voucher and its refund.
In the event of a return of a parcel following the reasons "NPAI", "NOT CLAIMED", or "REFUSED", Herman Headwear does not guarantee the reservation of the items ordered and may be required to reimburse the order if the products are no longer available.
The customer can withdraw without cause, within fourteen (14) calendar days (weekends and public holidays are included) from the delivery of the order. This withdrawal will be exercised by the return at its expense of the new product (in its original packaging, with the label on the product and in a perfect state of resale), accompanied by the invoice available on his account and the form of return duly completed, to the following address: HERMAN HEADWEAR, rue Jean Meunier 6, B-6992 WELLIN (Belgium).
Herman Headwear will reimburse the customer for any sums already paid, less any shipping costs. Refunds for products will be made by Herman Headwear within a maximum period of thirty (30) days after receipt of said products. The refund will be made according to the same payment method chosen by the customer at the time of his order.
The customer can exchange his product without cause, within fourteen (14) calendar days (weekends and holidays are included) from the delivery of the order which will be carried out by the return at his expense from new product (in its original packaging, with the label on the product and in perfect condition for resale), accompanied by the invoice available on its account, at the following address: HERMAN HEADWEAR, Rue Jean Meunier 6, B -6992 WELLIN (Belgium).
Herman Headwear only allows exchange for a product that is similar or has the same or lower value. Upon receipt of said products, Herman Headwear will proceed with the exchange and, if necessary, refund the difference. If the customer wishes to exchange for a higher value product, Herman Headwear will refund your account within thirty (30) days of receipt of said products. The customer can re-order a product of their choice.
Liability and intellectual property
Herman Headwear cannot be held liable for any inconvenience or damage inherent in the use of the Internet network and totally outside the diligence and precautions taken by Herman Headwear. In particular, any disruption in the provision of the service, or any external intrusion or presence of computer virus, cannot engage the responsibility of Herman Headwear. Likewise, any fact qualified as force majeure totally exonerates Herman Headwear from any liability.
All elements of the Herman Headwear site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of Herman Headwear. Any hypertext link to the Herman Headwear site and using in particular the technique of framing, deep-linking, in-line linking or any other deep link technique is, in any event, formally prohibited. In all cases, any link, even tacitly authorized, must be withdrawn at the simple request of Herman Headwear.
Herman Headwear, for the purposes of the service, reserves the right to collect personal data relating to users of the site, in particular by means of "cookies" referred to in article 5.1.
